Article 1: Definition
For the purposes of this legal notice, the following terms are defined as follows:
- Customer: Any professional or natural person capable within the meaning of articles 1145 et seq. of the French Civil Code, or legal entity, who visits the Site which is the subject of these general terms and conditions;
- Content: All the elements making up the information on the Site, in particular text – images – videos.
- Customer information: Hereinafter referred to as ‘Information (s)’ which corresponds to all personal data that may be held by GREEN POWER TECHNOLOGIE for the management of your account, customer relationship management and for analysis and statistical purposes;
- User: Any natural or legal person who accesses the greenpower-technologie.com Site and/or uses the Services offered by GREEN POWER TECHNOLOGIE;
- Personal information: ‘Information which allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies’ (article 4 of law no. 78-17 of 6 January 1978);
- For the purposes of this legal notice, the terms ‘personal data’, ‘data subject’, ‘processor’ and ‘sensitive data’ shall be understood in accordance with the definitions given by the General Data Protection Regulation (GDPR) no. 2016/679 of 27 April 2016.

Pursuant to Article 6 of Law No. 2004-575 of 21 June 2004 on confidence in the digital economy, users of the GREEN POWER TECHNOLOGIE website are informed of the identity of the various parties involved in its creation and monitoring:

The purpose of the Site is to present the activities, products and services of GREEN POWER TECHNOLOGIE, and to provide relevant information to its customers, partners and prospective customers. The information appearing on the site is only available for consultation by users.
Article 4: General conditions of use of the site and the services offered
4.1 Intellectual Property
The Site, as well as all its components (in particular texts, images, graphics, logos, icons, sounds, software, etc.), constitute an intellectual work protected by the provisions of the French Intellectual Property Code and applicable international regulations concerning copyright, trademarks and patents.
Consequently, without the prior written authorization of GREEN POWER TECHNOLOGIE, any reproduction, representation, modification, publication, adaptation, translation, distribution, commercial or non-commercial exploitation of all or part of the elements making up the Site, whatever the means or process used, is strictly forbidden and constitutes an infringement punishable by articles L335-2 et seq. of the French Intellectual Property Code.

Access to and use of the greenpower-technologie.com website implies full and unreserved acceptance of the present legal notice. The User acknowledges having read the legal notices and undertakes to comply with them.
4.3 Site accessibility
In principle, the Site is accessible 24 hours a day, 7 days a week, except in the event of scheduled or unscheduled interruption for maintenance purposes or in the event of force majeure. GREEN POWER TECHNOLOGIE undertakes to use all reasonable means at its disposal to ensure quality access to the Site and to ensure its security. The information provided is purely informative and indicative, and in no way constitutes a contractual commitment on the part of GREEN POWER TECHNOLOGIE. Article 5: Contractual limitations on technical data

5.2 Hosting
The greenpower-technologie.com Site is hosted by a service provider located in the territory of the European Union, in compliance with the provisions of the RGPD. The host undertakes to ensure the continuity of the hosting service 24 hours a day, 7 days a week. However, it reserves the right to interrupt the service temporarily, in particular for reasons of technical maintenance, improvement of its infrastructures, in the event of failure of its infrastructures, or in the event of abnormally high traffic on the Site.
GREEN POWER TECHNOLOGIE acts as the publisher of greenpower-technologie.com.
Article 6 : Liability
GREEN POWER TECHNOLOGIE shall not be held liable for any direct or indirect material damage caused to the User’s equipment when accessing or using the Site, and resulting in particular from:
- The use of equipment that does not comply with the minimum recommended specifications (up-to-date browser, absence of viruses, etc.);
- The presence of viruses or other harmful elements on the User’s equipment;
- Malfunction, incompatibility or fraudulent intrusion;
- Interruption of service due to maintenance, breakdown or force majeure;
- Indirect damage, such as, but not limited to, loss of data, loss of profits, loss of business, operating loss or loss of opportunity, resulting from the use or inability to use the Site.
The User undertakes to access the Site using equipment that is recent and up-to-date, free of viruses and equipped with the latest generation browser. It is the User’s responsibility to take all appropriate measures to protect his/her own data and/or software from contamination by any viruses circulating on the Internet.
In addition, GREEN POWER TECHNOLOGIE and its host cannot be held responsible for :
- Errors or omissions affecting the content of the Site;
- Difficulties in accessing the Site due to disruptions in the Internet network, telephone lines, communication networks or failures in the User’s computer or telephone equipment (particularly in the event of network saturation preventing access to the server);
- Direct or indirect damage caused by the use of information on the Site;
GREEN POWER TECHNOLOGIE uses all reasonable means at its disposal to ensure quality access to the Site and guarantee data security. However, GREEN POWER TECHNOLOGIE cannot be held responsible for:
- Temporary interruptions to the Site due to maintenance operations, technical problems or force majeure;
- Any intrusion by third parties into the Site’s computer system, despite the security measures in place;
- Any direct or indirect damage resulting from use of the Site, in particular loss of data, operating loss, financial loss or any other prejudice.
Article 7 : Personal data management
GREEN POWER TECHNOLOGIE attaches the utmost importance to the protection of its Users’ personal data and complies with the regulations in force, in particular Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, the Law of June 21, 2014 for confidence in the Digital Economy, the Data Protection Law of August 6, 2004 and the General Data Protection Regulation of April 27, 2016 (GDPR: No. 2016-679).
7.1 Purposes of the Data Collected
GREEN POWER TECHNOLOGIE is likely to process all or part of the data for the following purposes:
- Browsing and services: To enable browsing on the Site, management and traceability of services and services ordered (Site connection and usage data, invoicing, order history, etc.) ;
- Security and fraud prevention: Preventing and combating computer fraud (spamming, hacking, etc.), including the hardware used for browsing, IP address and password (hash);

GREEN POWER TECHNOLOGIE will keep the data thus collected for a period of 2 years, covering the period of prescription of the applicable contractual civil liability.
7.2 Recipient of personal data
The personal data collected is intended for the exclusive use of GREEN POWER TECHNOLOGIE. The data collected will not be transferred to third parties for commercial purposes.
7.3 Data security and confidentiality
GREEN POWER TECHNOLOGIE implements appropriate technical and organizational measures to ensure the security and confidentiality of Users’ personal data, and in particular to prevent it from being distorted, damaged or accessed by unauthorized third parties. These measures include standard devices such as firewalls, data pseudonymization and encryption, and password management.
However, the User is aware that no method of transmission over the Internet and no method of electronic storage is totally infallible. Consequently, despite GREEN POWER TECHNOLOGIE’s best efforts, absolute security cannot be guaranteed. GREEN POWER TECHNOLOGIE undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not communicated to unauthorized persons.
7.4 Notification of Violations of Personal Data
In the event of a personal data breach likely to give rise to a risk to the rights and freedoms of natural persons, GREEN POWER TECHNOLOGIE undertakes to notify the competent supervisory authority of such breach as soon as possible and, if possible, no later than 72 hours after becoming aware of it, in accordance with Article 33 of the RGPD.
GREEN POWER TECHNOLOGIE also undertakes to inform the Users affected by the breach, as soon as possible, where the breach is likely to result in a high risk to their rights and freedoms, in accordance with Article 34 of the RGPD. This notification will contain at least the following information:
- The nature of the violation;
- The categories and approximate number of persons concerned;
- The categories and approximate number of personal data records concerned;
- The likely consequences of the breach;
- The measures taken or proposed to remedy the breach, including, where appropriate, measures to mitigate any negative consequences.
7.5 Non-disclosure and transfer of Personal Data
No personal information of the User is published without his/her knowledge, nor exchanged, transferred, assigned or sold on any medium whatsoever to third parties, except in the cases expressly provided for by law or with his/her prior and informed consent.
GREEN POWER TECHNOLOGIE will not process, host or transfer the Information collected on its Customers to a country located outside the European Union or recognized as “non-adequate” by the European Commission without first informing the Customer and ensuring that appropriate safeguards are in place.
Only in the event of a merger-acquisition or sale of GREEN POWER TECHNOLOGIE and its assets, involving the transfer of personal data, would it be possible to transmit this information to the eventual purchaser. In this case, the latter would in turn be bound by the same obligations of security, confidentiality and information towards Users, in accordance with the regulations in force.
7.6 Users’ rights
In accordance with current European regulations, Users have the following rights:
- Right of access (Article 15 RGPD), rectification (Article 16 RGPD), updating and completeness of data ;
- Right to block or delete data (Article 17 RGPD) when it is inaccurate, incomplete, equivocal, out of date, or whose collection, use, communication or storage is prohibited ;
- Right to withdraw consent at any time (Article 13-2c RGPD) ;
- Right to limit data processing (Article 18 RGPD);
- Right to object to data processing (Article 21 RGPD) ;
- Right to portability of data provided, where such data is subject to automated processing based on consent or contract (Article 20 RGPD) ;
- Right to define the fate of data after death and to choose to whom GREEN POWER TECHNOLOGIE should communicate (or not) this data to a previously designated third party.
7.7 Data controller and exercise of these rights
Any person whose personal data is processed by GREEN POWER TECHNOLOGIE may, at any time, request the deletion of their personal data in the following cases:
- If the data is no longer required for the purposes for which it was collected or processed;
- If the data subject withdraws the consent on which the processing is based, and there is no other legal basis for the processing;
- If the data subject objects to the processing of his/her personal data and there are no compelling legitimate grounds for the processing, or objects to the processing for canvassing purposes.
These rights may be exercised by contacting the person responsible for processing the Personal Data collected (hereinafter “DPO”). The DPO’s duties are as follows:
- Inform and advise management and employees on their data protection obligations;
- Monitor the company’s compliance with the RGPD ;
- Cooperate with the supervisory authority (CNIL in France) in the event of a request ;
- Ensure a point of contact for data subjects and respond to their requests.
To this end, it benefits from the following means:
- Direct access to general management;
- The necessary human resources;
- Access to all the information required to perform his/her duties.
The DPO performs his or her duties in complete independence, and may not receive instructions concerning the performance of his or her tasks. The DPO’s mission is for an indefinite period.

Requests for the deletion of Personal Data will be subject to the legal obligations imposed on GREEN POWER TECHNOLOGIE, in particular as regards the retention or archiving of documents.
Users may also lodge a complaint with the supervisory authorities, in particular the CNIL (https://www.cnil.fr/fr/plaintes).
7.8 Force majeure
Neither party may be held liable for breach of any of its contractual obligations where such breach is caused by force majeure, i.e. an impediment beyond the control of the parties which could not reasonably have been foreseen and which renders performance of the obligations impossible or so exorbitant that it is reasonable in the circumstances to consider it impossible.
It is expressly agreed that, in addition to the cases generally recognized by jurisprudence, the following are considered to be cases of force majeure: exceptional weather conditions, natural disasters such as earthquakes, floods, fires, lightning; strikes, lock-outs or other union actions; explosions, attacks, wars, military operations, civil unrest, riots, embargoes imposed as part of economic sanctions programs.
The party affected by force majeure undertakes to inform the other party in writing as soon as possible of the occurrence of the force majeure event.
The occurrence of a case of force majeure may suspend all or part of the performance of the present legal notice.
In general, the parties undertake to use all necessary and reasonable means to put an end to the disruptions that have temporarily interrupted the service and to minimize the consequences of the force majeure event on the execution and respect of the present legal notice.

The greenpower-technologie.com LINK site may contain hypertext links to other websites. GREEN POWER TECHNOLOGIE has no control over the content of these third-party sites and declines all responsibility for their content and privacy policy. The User is invited to consult the legal notices and privacy policy of these sites before any use.
8.2 Cookies and Tracers
